Services are provided directly to our business clients and, in connection with those services, to their customers (e.g., patients, guests, or prospective customers) through automated and manual communications.

3. User Responsibilities

By using our Services, you agree to:

  • Use our Services only for lawful purposes

  • Reverse-engineer, scrape, or misuse any software, workflows, or automation systems provided as part of our Services
  • Misrepresent your identity or affiliation when communicating with customers or prospects through our platform
  • Violate any applicable local, state, federal, or international law, including but not limited to the TCPA, CAN-SPAM Act, and carrier/A2P 10DLC messaging requirements

We reserve the right to suspend or terminate access to our Services for any user or client found in violation of this section.

5. SMS Messaging Terms

This section governs all SMS/text messaging communications sent by Geek Marketing Lab LLC and its clients through our platform.

a) Consent & Opt-In By providing your mobile phone number through a web form, appointment request, missed-call trigger, or other consent mechanism, you agree to receive SMS messages from the applicable business related to appointments, reminders, review requests, and — where separately consented to — promotional offers. Consent to receive SMS messages is not a condition of purchasing any goods or services.

b) Message Types & Frequency Message types may include appointment confirmations and reminders, missed-call follow-ups, review requests, and promotional messages. Message frequency varies depending on your interactions and the business’s messaging program, and may range from occasional to several messages per month.

c) Message & Data Rates Message and data rates may apply, depending on your mobile carrier and plan. Geek Marketing Lab LLC and its clients are not responsible for any charges from your wireless carrier related to receiving text messages.

d) Opt-Out Instructions You may opt out of receiving SMS messages at any time by replying STOP to any message received. Upon receipt of STOP, we will send one final confirmation message and cease all further non-essential texts. You may be re-subscribed only if you affirmatively opt in again.

e) Help Instructions For assistance at any time, reply HELP to any message, or contact us directly using the information in Section 11.

f) Carrier Liability Disclaimer Carriers are not liable for delayed or undelivered messages. Wireless carriers are not responsible for any communications sent through their network related to our Services.

6. Intellectual Property

All content, trademarks, logos, workflows, templates, creative assets, and materials created or provided by Geek Marketing Lab LLC in connection with our Services (excluding client-owned brand assets provided to us) remain the intellectual property of Geek Marketing Lab LLC or its licensors.

Clients receive a limited, non-exclusive, non-transferable license to use deliverables (e.g., ad creative, automation workflows, content) solely for their own business purposes as contemplated by their service agreement with us. Clients may not resell, sublicense, or repurpose our proprietary systems, templates, or automation frameworks without prior written consent.

Any client-provided branding, logos, or content used in the course of our Services remain the property of the client.

7. Disclaimers

Our Services are provided on an “as is” and “as available” basis. Geek Marketing Lab LLC makes no warranties, express or implied, regarding:

  • The uninterrupted or error-free operation of our Services or any third-party platform (including GoHighLevel)
  • Specific marketing results, lead volume, appointment volume, or revenue outcomes
  • The accuracy or completeness of any content, automation, or communications generated on behalf of a client

Marketing and automation results depend on numerous factors outside our control, including market conditions, client responsiveness, and third-party platform performance. We do not guarantee specific business outcomes.

8. Limitation of Liability

To the fullest extent permitted by law, Geek Marketing Lab LLC and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising out of or related to your use of our Services, even if advised of the possibility of such damages.

Our total aggregate liability for any claim arising from these Terms or our Services shall not exceed the total amount paid by you to Geek Marketing Lab LLC in the three (3) months preceding the event giving rise to the claim.
